These general terms and conditions of business apply to all commercial transactions carried out in our online store of TheSoleJungle, hereinafter referred to as The Seller. For more information about The Seller and our Privacy Policy, please refer to the Legal Notice located at the bottom of each page of this store.

Please read these Terms of Purchase and our Privacy Policy carefully before ordering. If you do not agree with all the Terms of Purchase and the Privacy Policy, you should not place an order.

 

  1. Identification.

A Seller is a business unit of TheSoleJungle. Any communication may be addressed to the registered office or e-mail address info@thesolejungle.com.

  1. Activity.

The Seller is engaged in distance selling, preferably via the Internet, selling online.

  1. Contents and information provided on the website.

Seller reserves the right to modify the commercial offer presented on the website (modifications on products, prices, promotions, and other commercial and service conditions) at any time. The Seller makes every effort within its means to provide the information contained on the website in a truthful and error-free manner. If at any time, there is an error of this type, at all times outside the will of The Seller, it will proceed immediately to correct it. If there is a typographical error in any of the prices shown, and a customer has made a purchase decision based on that error, The Seller will inform the customer of the error, and the customer will have the right to cancel the purchase without any cost on his part.

The contents of the Seller’s website may, occasionally, show interim information about some products. If the information provided does not correspond to the characteristics of the product, the customer will have the right to cancel the purchase without any cost on his part.

We are not responsible either directly or indirectly for any of the information, content, statements, and expressions contained in the products marketed by The Seller. Such responsibility lies at all times with the manufacturers or distributors of such products. The customer understands that The Seller is a mere intermediary between him and said manufacturer or distributor.

  1. Selling system.

4.1. In order to place an order, the customer must be at least 18 years old. If you are a minor, ask your parents or legal guardians to place the order on their behalf.

However, if you are between 14 and 18 years old, you can request information about products and events. In any case, it is recommended that you have your parents or legal representatives with you before browsing and/or registering on our websites or mobile applications so that they can explain any questions you may have.

If you are under 14, please do not provide any personal information.

4.2. The Customer must complete the personal data form found in our Online Shops (available 24h/day, every day), once he/she has accessed the page and clicked on the «finish order» button.

4.3. When the Customer finishes his order, we will send him an e-mail with the number and details of his order.

4.4. In case of any problem with the shipment of the material, for example, problems with the manufacture, or its discontinuation, we will contact the customer as soon as possible to inform him about the situation and suggest alternative products he may wish to buy. Or we will propose a refund of any money paid to us for such products. The refund of these sums of money will be the limit of our responsibility towards the Customer if we can’t supply the products ordered.

4.5. The customer will be able to cancel the order at any time without any additional cost, as long as it has not been invoiced and sent through the transport company. If the package has left our premises, the customer may reject it with the transport company upon receipt of the package.

4.6. The availability of products on the web is constantly changing and reflects the situation in real-time. Adding an item to the shopping cart does not guarantee that it will be reserved for the customer, as other customers may have purchased it while they were browsing the site. Once the payment process has been completed, the product is reserved for the customer.

4.7. We will make every effort to supply you with the products listed in your order confirmation. However, there may be occasions when we can’t supply such products because, for example, such products are not in stock. In these cases, we will contact the Customer to inform them and perhaps suggest alternative products they may wish to purchase. If you do not accept our suggestions, we will cancel your order for the products we cannot supply and refund any money you would have paid for such products. The refund of these amounts of money will be the limit of our liability to the Customer if we are unable to supply the products ordered. On some occasions, the price of a particular product from our Online Shops may be wrong and show a higher or even lower price than the corresponding one due to a computer error. When this happens and if we have confirmed your order, we will contact the Customer as soon as possible.

  1. Applicable taxes.

The prices of the products displayed on the website of The Seller include the Value Added Tax (VAT) that, where appropriate, is applicable.

Purchases to be delivered within the territory of any of the member states of the European Union will be subject to VAT.

Purchases to be delivered in territories of states that are not members of the European Union, or in the Canary Islands, Ceuta or Melilla will be exempt from VAT.

  1. Payment Method

– Payment by credit/debit card.

If you choose to pay by card, the Customer’s order cannot be taken into account and will not be processed until the payment has been authorized by your bank or cashier. Online payment by credit card is made through the «Secure Socket Layer» security system, which encrypts your bank details when they are transmitted over the Internet. For security reasons, TheSoleJungle verifies all orders paid by bank card. We accept American Express, Maestro, and any Visa and Mastercard registered in the Verified by Visa secure payment system.

 

– Cash on delivery. (NOT CURRENTLY AVAILABLE)

The customer must pay the total amount of the order to the courier of the transport company, when he receives the order.* The additional cost of the service 10 Euros being the delivery time of 10 working days approximately.  TheSoleJungle is not responsible for delivery times as it depends on the transport company.

* The customer agrees to receive his order, if he refuses the order he will be charged 20 euros for handling and shipping costs, where he must pay by bank transfer where TheSoleUniverse will provide the IBAN account number to make the mentioned debit

– Payment by bank transfer.

The Customer must make the transfer to the account that will be indicated in due course.

IMPORTANT: As the concept of the transference, it will have to indicate the reference that will be indicated to him when finalizing the order. In case of not having indicated this reference, the order will be canceled, and the money returned after 5 days.

IMPORTANT: For payments by bank transfer, the products are not reserved until the deposit is received.

– Payment by bank deposit in ATMs of our entity or other entities in partnership with it.

The Client must deposit in the account that will be indicated to him opportunely.

IMPORTANT: As a concept, you must indicate the order number that will be indicated at the end of the order. In case of not having indicated the order number, the order will be canceled, and the money returned after 5 days.

IMPORTANT: For payments by deposit, the products are not reserved until we receive the deposit in the account.

 

  1. Form, costs, and delivery time.

7.1. We will send the Customer his products to the delivery address indicated in his personal data form.

7.2. On the website, specifically in the shopping cart, the amount of shipping costs is specified before making the purchase.

7.3. If the article indicates «in stock» when ordering, the time between the order and the date of the first presentation of the employee of the transport company in the given place corresponds to the sum of 2 elements:

– The preparation time (1 to 5 working days): validation of payment plus preparation of the order plus reception of the package by the employee of the transport company.

– The delivery time of the order by the transport company. You will be informed of this time limit from the moment you receive the «Sent” e-mail.

*This method of shipping may involve additional customs charges, which must be paid by the buyer and not by the seller.

 

7.4. We will deliver the product once we have verified that the successful completion of the payment has been made.

7.5. We understand hours and days as working hours and days, excluding Saturdays and Sundays and holidays. If this period is exceeded for any reason attributable to TheSoleJungle, we will inform the Client of the incident and propose alternative solutions.

 

7.6. The Customer agrees that he or another designated person will be at the address indicated to receive the package. If they are not there the first time, the carrier will insist several times. If the order still cannot be delivered, it will be returned to us, with the consequent return to the Customer of the payment made minus the shipping costs or return of the goods which will be borne by the Customer.

7.7. The Customer agrees to give the correct shipping address. In this case, TheSoleJungle is not responsible for delays or returns caused by wrong or incomplete addresses, please make sure before processing your order.

 

  1. The Right to Return of Products and Withdrawal.

8.1. In case that the Customer is not satisfied with the product he has purchased, due to faults or manufacturing defects (for this reason only), he may return the product to us and arrange for a refund with TheSoleJungle.

8.2. No returns can be made for changes in size, color, texture, or any other aspect that the customer considers.

8.3. As far as possible, the product must be returned in its original external box or packaging and well protected to avoid damage in transit. Otherwise, the products will be depreciated, and the customer will be notified once the return is received. Also, all original documentation, as received at your home, must be included.

8.4. Once we receive the goods in our warehouse, and after checking the status of it, the return of the product will be accepted, and proceed to the refund of its amount (agreed in section 11.1) according to the method of payment made by the Customer:

– If payment was made by credit card, the amount would be credited to the same credit card.

– If payment was made by transfer, we would ask you for an account number where the amount will be credited.

8.5. The company has the right to refuse any product that does not come in the right conditions for its later sale. These products will be returned to the sender without prior notice.

  1. Customer obligations.

The Seller’s customer agrees at all times to provide truthful information about the data requested in the user registration or order forms and to keep them updated at all times.

The customer undertakes to accept all the provisions and conditions contained in these General Terms and Conditions of Business, understanding that they include the best possible service for the type of activity carried out by The Seller.

Likewise, he commits himself to keep his access codes to our website confidential and with the maximum diligence.

The customer undertakes to make possible the delivery of the requested order by providing a delivery address where the requested order can be delivered within the usual hours of delivery of goods (Monday to Friday from 10:00 to 13:30 and from 16:00 to 18:00). In the event of failure by the customer to comply with this obligation, the Seller shall have no liability for the delay or impossibility of delivering the order requested by the customer.

  1. Applicable legislation and competent jurisdiction.

This contract shall be interpreted and governed by the Spanish legislation in force.
